ON-LINE PURCHASING CONDITIONS

All purchases made through the JOSEP NOBLOM LLOBET portal are subject to the general conditions set out in the legal notice. The General Conditions prevail over the On-line Purchase Conditions.

All products and services are subject to the following conditions. By purchasing on this website, you automatically accept these conditions. Please read them carefully.

These conditions constitute the entire agreement between the parties with regard to on-line purchase and sale transactions between JOSEP NOBLOM LLOBET and its customers.

JOSEP NOBLOM LLOBET is empowered to unilaterally modify each and every one of the obligations set out in these conditions, without the need for prior notice. It is likewise empowered to restructure, modify or eliminate any information, service or content included on the Portal, without the need for prior notice.

A purchase is not definitive until it is accepted by JOSEP NOBLOM LLOBET JOSEP NOBLOM LLOBET reserves the right of admission and cancellation of any order, and may return the amount paid by the customer and is exempt from any other obligation.

The Portal does not require prior subscription for simple browsing, access or use of the service in question. On the contrary, for access to certain content and services, prior subscription and the corresponding registration as a User (hereinafter referred to as a Registered User) will be required.

User Registration

In accordance with the above, JOSEP NOBLOM LLOBET reserves some of the Services offered through the Portal for Registered Users of JOSEP NOBLOM LLOBET by completing the corresponding User registration form.

The User undertakes to select, use and maintain his or her user name or "login" and password (hereinafter collectively the "Access Keys") in accordance with the provisions of the following clauses.

Assignment of Access Keys

The User shall have the option to choose and indicate his or her own access password. The User will not be able to choose the User Name in any other way than being a valid e-mail address, through which we will communicate with the User.

Use and Custody

The User undertakes to make lawful and diligent use of the Access Key and not to make the Access Key available to third parties.

The User undertakes to inform the Webmaster of JOSEP NOBLOM LLOBET as soon as possible of the loss or theft of the Access Codes and of any risk of access to them by a third party.

The Access Password may only be used by Users to whom it has been assigned. JOSEP NOBLOM LLOBET is exonerated from any type of liability that may arise for damages caused or suffered as a result of fraudulent use or lack of diligence in the safekeeping and custody of the Access Key, loss or use in contravention of the provisions of these Conditions.

Products

The information provided should at no time be considered either complete or exhaustive due to the wide range of products and services existing in the sector. JOSEP NOBLOM LLOBET will try as far as possible to constantly update the prices of the products by means of constant communication with the suppliers and manufacturers.

JOSEP NOBLOM LLOBET declares that the product offered usually corresponds to the photograph. Nevertheless, JOSEP NOBLOM LLOBET is exonerated from liability for those cases in which, due to technical or human error, there are mistakes or variations between the photograph and the price. It is also made clear that the photographs are merely indicative and there may be variations in terms of physical appearance but without undermining the integrity and performance of the product ordered.

JOSEP NOBLOM LLOBET accepts no responsibility for the contents, information, opinions or comments disseminated through its portal, nor shall it be liable for the use made of this information by the User.

Price list

The price of the products is in EUROS and includes the applicable taxes according to the Spanish Legislation. The final purchase summary shows the final or total price of the purchase, indicating the amount corresponding to the price of the specific product and the amount corresponding to the applicable taxes.

Based on its commercial policy, JOSEP NOBLOM LLOBET may make final price variations either for loyalty, for the acquisition of products of a certain entity or relevance as well as others that may be stipulated by JOSEP NOBLOM LLOBET at the appropriate time. However, it will be JOSEP NOBLOM LLOBET who freely and voluntarily offers these discounts and/or reductions to those he deems appropriate, and they may not be demanded or requested at any time by the customer.

Prices do not include shipping costs. Prices are valid except for typing errors. All sales are made with the corresponding invoice. Products are available for sale while stocks last.

The prices shown may be revised and modified at any time by JOSEP NOBLOM LLOBET.

Once payment has been verified, JOSEP NOBLOM LLOBET will start processing the order.

Methods of payment

Once inside your account you will see your shopping cart and then you must click on "Confirm order" and you will go to Shipping and Payment. In this part you must specify whether you want the order to be sent to your registered address or to a different one, and then make the payment according to the chosen method, by clicking on "Finish order". Once the payment has been completed, you will see the confirmation of registration of the order and you will immediately receive this confirmation by e-mail.

A) Transfer. If you choose to pay by bank transfer (or direct debit) you will be provided with an account number for payment.

B) Credit card. Payment by credit card is made through a payment gateway with the bank's secure server. CAIXABANK. At no time are any card details stored in our database. This data is always processed by the bank.

(C) PAYPAL. Payment is made through the international payment system Paypal. This payment method involves a commission. For further information, please contact www.paypal.es.

Shipping

JOSEP NOBLOM LLOBETwill not send any product until the Administration Department has checked that payment has been made.

Delivery shall be deemed to have taken place as soon as the carrier has placed the products at the customer's disposal and the customer has signed the delivery acceptance document. It is the customer's responsibility to check the products on receipt and to state any reservations and complaints that may be justified in the delivery receipt document.

JOSEP NOBLOM LLOBET will send the products by the means it deems appropriate to fulfil its commitments.

Shipping costs

A delivery charge will be applied depending on the delivery area selected. However, JOSEP NOBLOM LLOBETSE RESERVES THE RIGHT TO REQUEST AN ADDITIONAL AMOUNT for particularly heavy or bulky orders. In the event that this occurs and the customer is not interested in placing the order with the delivery costs indicated, the amount paid will be refunded and the order will be cancelled. JOSEP NOBLOM LLOBET shall be exempt from any other commitment or obligation to the customer.

Shipping costs for orders in mainland Spain will be from 6€ to 9,4€ depending on the weight of the shipment. However, for orders over 60€ the shipping will be free of charge.

Delivery time

Generally, an order is shipped (leaves our offices for destination) on the next business day for orders for which proof of payment has been sent to us before 12:00 noon. If proof of payment is sent after this time, two working days later. Delivery at destination will be made depending on the destination area. In mainland Spain, it will be the working day following the day of shipment. For shipments to the Balearic Islands, the delivery time may be increased by 2 or 3 days. However, these delivery times are approximate and may vary for reasons beyond our company's control. JOSEP NOBLOM LLOBET does not commit itself to any specific delivery time, as the shipping process depends on third parties.

If a delivery is going to take more than 5 working days, JOSEP NOBLOM LLOBET will contact the customer to inform them of this and give them the option of cancelling the order and receiving their money back immediately by bank transfer.

Stock outs

On our website we only offer for sale products in stock, either in our own warehouse or in the warehouse of an entity, manufacturer or wholesaler that allows us to serve the product in the time described as delivery time. However, the synchronisation of the website with the warehouses is not instantaneous. In addition, in the period of time between a customer registering an order on the portal until we receive and process the proof of payment, some products may run out of stock. Therefore, there may be isolated cases in which we are unable to deliver an order due to lack of stock.

When it is not possible to supply a product due to lack of stock, JOSEP NOBLOM LLOBET will contact the customer to inform them of this, cancel the order and refund their money immediately by bank transfer.

Guarantee

Own products:

In order to exercise the warranty claim, the product must be returned together with the original packaging and always with the prior authorisation of the Customer Service Department (info@noblethandpans.com ).

RIGHT OF WITHDRAWAL AND RETURNS

How to exercise the right of withdrawal: To exercise the right of withdrawal with respect to products purchased exclusively on https://noblethandpans.com/, you must express your unequivocal decision to withdraw from the contract, within 14 calendar days, in one of the following ways:

• If you choose the option of returning the product to any of the JOSEP NOBLOM LLOBET shops, you must first contact our Customer Service Department on 628 631 877, who will send you a return authorisation that you will have to present at the shop.
• If you choose the option of returning the product through our online shop at https://noblethandpans.com/ you must contact our Customer Service Department on 628 631 877 or via the email account info@noblethandpans.com to unequivocally state your decision to withdraw from the contract.
• Without prejudice to the provisions of the preceding paragraphs, you may also choose to exercise your right of withdrawal by completing and sending electronically to the email account info@noblethandpans.comel withdrawal form that you can download by CLICKING HERE, in which case, we will inform you promptly by email of the receipt of such withdrawal.

The right of withdrawal shall be deemed to have been exercised within the deadline when you have sent us the communication concerning the exercise of this right before the end of the corresponding deadline, in the terms indicated above.

Consequences of withdrawal: If you exercise your right of withdrawal, we will refund all payments received from you, excluding delivery costs, without undue delay and in any event not later than 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. We will proceed to carry out such reimbursement using the same means of payment in which the purchase was paid for without you incurring any costs as a result of the reimbursement except for the costs of returning the product. In all cases, the products to be returned must be in perfect condition, in their original packaging and with the manuals, accessories or promotional gifts, if applicable, included. If this is not the case, the withdrawal cannot be exercised.

Jurisdiction, Jurisdiction and Legislation

The parties submit to the courts and tribunals of the domicile of JOSEP NOBLOM LLOBET for the resolution of conflicts, renouncing any other jurisdiction.
